display: inline !important; float: none;">The Agencies recently proposed rules that, if finalized, will require certain large banks and their holding companies to issue and maintain minimum levels of LTD and to comply with other associated requirements. These requirements are designed to provide the Agencies with greater flexibility in responding to failures, increase the likelihood of orderly and cost-effective bank resolution, and improve banking organization resilience by enhancing the stability of bank funding profiles. The proposals specify eligible LTD, provide legacy treatment for certain types of existing LTD, and give covered entities a three-year transition period. Together with "clean holding company" requirements, the proposals will have a significant impact on the existing liability structure of banks and their holding companies. Covered entities may encounter challenges as they work to align their liability structure with the proposals’ requirements.
